Purpose of Post
To provide a Paid relevant Person’s Representative Service for individuals who are subject to Deprivation of Liberties Safeguarding. The Deprivation of Liberty Safeguards are an amendment to the Mental Capacity Act 2005.
To provide high quality, non-instructed advocacy for those assessed as lacking capacity within the meaning of the Mental Capacity Act (and subsequent amendments) who are subject to Deprivation of Liberty Safeguards, ensuring an holistic approach to advocacy based on the assessment of the rights and needs of individuals
Main Tasks
* To undertake the role of Paid Relevant Persons Representative worker as set out in the Mental Capacity Act amendment Deprivation of Liberty Safeguarding.
* To assist in the continued development of the Paid Relevant Persons Representative service across the above areas.
* To liaise, communicate and negotiate effectively with a range of health and social care personnel and managers.
* To undertake joint working with a range of health and social care professionals and managers.
* To ensure health and social care professionals and managers within registered home settings have an awareness and understanding of the role of the Paid relevant Persons representative and the rights of individuals requiring Paid Relevant Persons Representative support.
* To signpost and refer on people for issues that fall outside the scope of the Act, to receive and respond to referrals as required by the Advocacy Coordinator within 2 working days from the initial date of receipt.
* To prioritise work to meet the needs of individuals and decision makers as necessary.
* To identify any conflicts of interests associated with Litigation Friend and IMCA cases including Deprivation of Liberty Safeguarding to help ensure they are appropriately managed and where necessary inform the Advocacy Coordinator.
* To recognise and deal with potential risks and awareness of personal safety i.e. lone worker policy.
* To attend the Court of Protection in the role of Litigation Friend as requested by the courts (support from specialised staff available).
* To maintain client records in compliance with the Data Protection Act (1998).
* To ensure case notes are completed accurately and factually and entered onto the organisations Advocacy Case Management Database in a timely manner.
* Produce high quality reports on work undertaken as required in the role of Paid Relevant Persons Representative worker.
* To ensure all cases are closed when the Deprivation of Liberty Safeguard ends on a client.
* To ensure the requirements for internal and external monitoring and evaluation are met.
* Where necessary, undertake and provide presentations and training sessions to staff about the Depredation of Liberty Safeguarding and the role of the Paid Relevant Persons Representative in relation to the Act.
* To keep up to date with policy and legal changes relating to the Paid Relevant Persons Representative role.
Professional Development
* To undertake an initial training and induction programme.
* To participate in regular supervision, annual appraisal and personal development meetings with the Advocacy Coordinator.
* To undertake agreed on-going training/personal development.
* To Complete the National Advocacy Qualification within one year.
Team Work
* To participate in monthly team meetings.
* To support the learning and practice of other members of the Paid Relevant Persons Representative and the Independent Mental Capacity Advocacy team as appropriate.
* To be a Team Player.
Corporate Requirements
* To work in line with Mental Health Matters Wales policies and procedures.
* To adhere to and promote the value base of Mental Health Matters Wales.
General
It may be required from time to time to perform other duties that may be required by the employer to provide effective advocacy to clients and to ensure the efficient running of the organisation.
Other than when office admin support is available, to be administratively self-servicing
